Thank you for visiting HealthfulHeroes.com and interest in becoming a Healthful Contributor (“HC” to HealthfulHeroes.com (“Website” or the “Portal”), sponsored by Healthful Stories, Inc., a Non-Profit 501(c)(3) Organization (creator and operator of “HealthfulHeroes.com,” “HSI,” “we,” or “us”). By becoming a HC, you agree to abide by our Terms and Conditions of Use (“Services”), this Privacy Policy, and acknowledge that sharing your Healthful Story^TM is at your sole discretion.

Key Definitions

1. Public Areas: The Services include functionality that allows Users to upload Content, blogs, message boards, Ask an Expert, forums, and other public areas (collectively “Public Areas”). Please remember that the content you choose to share in Public Areas will be available to the other Healthful Contributors and the potentially the General Public. Accordingly, please consider carefully what content you choose to share while using the Public Areas. Do not share private information in Public Areas. By submitting content to Public Areas, you agree that submissions to Public Areas are non-confidential for all purposes.
2. Aggregate Information: information that has been combined with that of other Healthful Contributors and analyzed or evaluated as a whole, such that no specific individual may be reasonably identified.
3. De-identified Information: information that has been stripped of your Registration Information (e.g., your name and contact information) and other identifying data such that you cannot reasonably be identified as an individual, also known as pseudonymized information.
4. Healthful Story^TM: A Healthful Story is defined as any content provided by submitting, displaying, posting, and otherwise sharing or using the Services and will typically include, but is in no way limited to, a detailed recall-based chronicle of your background and experience from initial symptoms, through to diagnosis, and treatment for one or more health conditions or illnesses. A Healthful Story may either be submitted directly to HealthfulHeroes.com. Your content might include text, files, documents, reports, results, information, bulletins, images, photos, video, works, works of authorship, applications, or any other materials. You control what content you choose to share with other Users of the Services. Your use of the Services, including what content you share, is always voluntary.
5. Healthful Contributor: These are individuals who have voluntarily registered to share their Healthful Story^TM with the public via www.HealthfulHeroes.com
6. Personal Information: information that can be used to identify you, either alone or in combination with other information. HSI collects and stores the following types of Personal Information:
   1. Registration Information: information you provide about yourself when registering for and/or purchasing our Services (e.g. name, email, address, user ID and password, and payment information).
   2. Self-Reported Information: information you provide directly to us, either through the Services or through a third party, including your disease conditions, other health-related information, personal traits, ethnicity, family history, and other information that you enter into surveys, forms, or features while signed in to your HealthfulHeroes.com account.
   3. Sensitive Information: information about your health, and certain Self-Reported Information such as racial and ethnic origin, sexual orientation, and political affiliation.
   4. Contributor Content: information, data, text, software, music, audio, photographs, graphics, video, messages, or other materials – other than Self-Reported Information-generated by Contributors to HSI Services and transmitted, whether publicly or privately, to or through HSI.
   5. Inferences and Derived Data: information, data, assumptions, or conclusions that are derived directly or indirectly from another source of Personal Information. For example, we may use statistical techniques to infer additional information.
   6. Web-Behavior Information: information on how you use our Services collected through log files, cookies, web beacons, and similar technologies, (e.g., device information (device identifiers), IP address, browser type, domains, page views).

At HealthfulHeroes.com, we believe that sharing your information as a Healthful Story is at your sole discretion. If you do not feel comfortable sharing information and/or are concerned about your information being made accessible to the public, do not share it. HealthfulHeroes.com is not liable for information that you share. We do value the privacy of our contributors and will take reasonable precaution to remove any information that you do not wish to have made public should you provide us with sufficient written notification. We are committed to removing any content you would like removed within a reasonable timeframe.

Information Consent

Consent for Storing Your Healthful Story By choosing to contribute your Healthful Story to HealthfulHeroes.com, you are consenting to having Healthful Stories, Inc. and its partners, contractors / third party partners access to and analyze your stored Healthful Story, in a manner consistent with our Terms of Service and Privacy Statement. Unless we notify you otherwise, we will store your information indefinitely. We may contact you in the event we need further information regarding your Healthful Story. All content submitted to or available through the Services is the sole responsibility of the Healthful Contributor who submitted the content. Content posted or shared by other Healthful Contributors does not necessarily reflect the opinions or policies of HSI. We assume no responsibility for the content posted by any Healthful Contributor and no responsibility for the conduct of the Healthful Contributor with respect to any such content. HSI assumes no responsibility for monitoring the Services for inappropriate content or conduct, but we reserve the right, in our sole discretion, to investigate use of the Services and take appropriate action in accordance with these Terms. Other Healthful Contributors may alert us to inappropriate use of the Services, including inappropriate content or conduct. You agree to ensure that any content you share using the Services is yours to share, and that you are not violating the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. Keep this in mind because you are responsible for any rights clearance for any content you post or otherwise share. Part of Our Mission is to Conduct Original Scientific Research to Transform Healthcare at Massive Scale One of the missions of HealthfulHeroes.com is to make and support meaningful healthcare discoveries by enabling HSI customers to participate directly in research. HealthfulHeroes.com seeks to collect and publish millions of individual stories of health transformation either on the Site itself or via anonymized aggregate reports and may conduct directly, or through partners, research specifically to support scientific publication which we call Healthful Research. Specifically, Healthful Research refers to research aimed at publication in peer-reviewed journals and research funded by the federal government (such as the National Institutes of Health – NIH). Healthful Research may yield insights to policy-makers, healthcare providers, and others that helps to:

• Discover environmental or behavioral factors behind diseases and traits
• Uncover connections among diseases and traits
• Learn about gaps in the current healthcare system that might be fixed by policy changes and/or efforts by providers and others

The collection of some Healthful Heroes may occur in the form of surveys that may be sponsored by or conducted on behalf of third parties, such as non-profit foundations, academic institutions or pharmaceutical companies. Your Healthful Story may cover potentially sensitive topics such as sexual orientation, illicit drug use or other illegal behavior, or HIV/AIDS status. When Healthful Stories, Inc. conducts surveys on such sensitive topics, we may provide additional information to help you decide whether you want to participate in research on these topics. Research is an important aspect of our Healthful Services and we want to ensure interested participants are aware of additional opportunities to contribute to interesting, novel scientific research conducted by academic institutions, healthcare organizations, pharmaceutical companies, and other groups. If you have chosen to participate in Healthful Research, from time to time we may inform you of third party research opportunities for which you may be eligible. For example, if a university tells us about a new cancer research project, we may send an email to Healthful Research participants who potentially fit the relevant eligibility criteria to make them aware of the research project and provide a link to participate with the research organization conducting the study. We will not share Individual-level Self-Reported Information with any third party without your explicit consent. If you do not wish to receive these notifications, you can withdraw at any time by written notification to contact@healthfulheroes.com. We value your feedback and may send you surveys, polls, or requests for testimonials to improve and optimize our Services. You are in control of the information you would like to share with us. If you do not wish to receive these notifications, you can withdraw at any time by written notification to contact@healthfulheroes.com. By creating a Healthful Contributor account, you are agreeing that we may send you product and promotional emails or notifications about our Services, and offers on new products, services, promotions or contests. You may also opt-in to receiving similar notifications on the website or mobile application(s). If you wish to opt out of marketing communications / notifications about our Services or those of HSI third party affiliates, you can withdraw at any time by written notification to contact@healthfulheroes.com. There are benefits and Risks to Sharing Your Healthful Story with HealthfulHeroes.com and HSI 3rd Party Affiliates:

Benefits: Based on the results of analyzing your Healthful Story along with those of others, HSI may develop intellectual property, including but not limited to patents, copyrights and trademarks, and/or HSI may commercialize products or services, directly or indirectly. In such cases you will not receive any compensation.

Risks: There are some potential risks to contributing your Healthful Story to HealthfulHeroes.com or HSI, as described below.

• Although HSI cannot provide a 100% guarantee that your data will be safe, HSI will take reasonable precaution to limit the possibility of a breach.
• As with any online service, if you disclose your account password to others, they may be able to access your account and your Self-Reported Information.
• There may be additional risks to participation that are currently unforeseeable.

None of the surveys or other procedures used by HSI are invasive or experimental. The procedures involved do not involve more than the minimal risks described above. You should be thoughtful about your sharing choices. Once you have chosen to share any Personal Information, the individuals with whom you share this information, may also use or share your Personal Information, including any Sensitive Information you choose to share. For individuals located in the Countries Outside the US: Our legal basis for processing your Personal Information for the purpose described above is based on your consent. You may withdraw your consent at any time, however, the withdrawal of your consent will not affect the lawfulness of processing based on consent before its withdrawal. This Privacy Policy only applies to information that we may collect through our website and portal at www.HealthfulHeroes.com (the “Site”) or a future related smartphone application Healthful Heroes App available for download. By accessing or using the Site, you agree to be bound by Healthful Heroes Terms and Conditions of Use. Please read them carefully. To the extent you register on the Site as a Contributor, then in addition to the terms that are applicable to all users of the Site, the terms that apply only to Contributors shall apply to you too. Our Services in include software and interactive webpages, as well as access to certain features, functions, or content. Specifically, when creating a Healthful Contributor Profile or registering at HealthfulHeroes.com, you will be asked to use the HealthfulHeroes.com Web Portal and in the future, associated App, which are interactive software tools used to input your health and lifestyle information as part of our Healthful Mission.

Acceptance of Privacy Policy

Please read this Privacy Policy carefully. We want you to understand what data we collect from you when you visit the Site or otherwise use the App or other tools developed by HealthfulHeroes.com, how we use such data, and whether and with whom we share such data. Using the Tools is voluntary, and by accessing or using the Tools, you: (i) acknowledge that you have read and understood this Privacy Policy; (ii) agree that your access to and use of the Tools are subject to the Privacy Policy and related Terms and Conditions of Use; and (iii) consent to our collection and use of your data as described in this Privacy Policy.

Healthful Story Submitted Content License

By contributing content to HealthfulHeroes.com, all Contributors and others visiting HealthfulHeroes.com agree and are legally bound to recognize that all such contributed content will be 100% owned by Healthful Stories, Inc. Copyright shall be owned, without limitation, by Healthful Stories, Inc. Credits in all contributions will read “© Healthful Stories, Inc.” unless specified otherwise in written advance signed agreement by both the Contributor and Healthful Stories, Inc. Royalties from the publication of any content provided by the Contributor to HealthfulHeroes.com and from the disposition of any subsidiary rights therein (including but not limited to films, television and merchandising) shall be 100% owned by Healthful Stories, Inc. All original content provided by the Contributor, and the proceeds from the sale of such original content, shall remain the sole property of Healthful Stories, Inc. In the case of any commercialization, no payment will be made by HSI to Contributors and others visiting HealthfulHeroes.com. Any and all materials (which shall be treated as set forth in other provisions of this Privacy Policy and our Terms and Conditions of Use), including without limitation surveys, physician responses, suggestions, feedback, ideas, concepts, comments, illustrations and other materials that you disclose or offer to us on or in connection with this Site or any Site Materials (“Submissions”) are submitted by you without any restrictions or expectation of confidentiality. You hereby assign to HSI without additional consideration or further obligation, all rights now known or hereafter existing to use, allow others to use, or assign the right to use, the Submissions. You further agree that your Submissions may be used without restriction for any purpose whatsoever, commercial or otherwise, without compensation to you, including the right to use, reproduce, modify, adapt, publish, transmit, publicly perform or display, translate, create derivative works from, or otherwise communicate to the public the Submissions on this Site or elsewhere by us, our assigns or others we have allowed to use your Submissions. You will not assert any proprietary right or moral right of any kind with respect to any Submissions.

Photo, Video, Written, and Audio Release

In connection with your interaction with the HealthfulHeroes.com and HSI, provision of HSI Services, and participation in any initiatives supported by HSI, you may be required or requested to provide photos, videos and statements, participate in photo shoots, and participate in audio and video recording. Accordingly, you agree as follows: (a) All statements, photographs, audio recordings or video recordings taken of you by HSI, its contractors or Clients, or submitted by you to HSI, its contractors or Clients, may be used by HSI, its partners, its contractors or Clients, for promotional, commercial or other purposes as determined by HSI anywhere in the world in its sole discretion. You shall not have any right to control the use or publication by HSI, its contractors or Clients, of the written or oral statements, photographs, audio recordings or video recordings. (b) All statements, photographs, audio recordings or video recordings taken of you by HSI or its contractors, or submitted by you to HSI, shall be the sole property of HSI or its designee. You are not entitled to any compensation in connection with use of these written or oral statements, photographs, audio recordings or video recordings for promotional, commercial or other purposes. (c) You hereby release, waive and discharge any claims of any kind or nature arising out of or relating to the use of the written or oral statements, photographs, audio recordings or video recordings which you may have against HSI or any person or firm authorized by HSI to publish said materials (“Publisher”). Such release, waiver and discharge shall also extend to all affiliated companies, shareholders, directors, officers, employees, agents and assigns of HSI and any Publisher. (d) The releases of rights described above shall be binding on your successors, heirs, assigns, executors, administrators, spouse and next of kin. YOU HAVE READ THIS SECTION CAREFULLY AND YOU UNDERSTAND THAT YOU GIVE UP SUBSTANTIAL RIGHTS (INCLUDING RIGHTS RELATING TO PUBLICITY AND PRIVACY WITH RESPECT TO THE COMMERCIAL USE OF ANY WRITTEN OR ORAL STATEMENTS, PHOTOGRAPHS, AUDIO RECORDINGS OR VIDEO RECORDINGS) AND YOU AGREE TO THIS RELEASE FREELY AND VOLUNTARILY.

Residents of the United States

Currently, the Services, HealthfulHeroes.com website, web Portal and future App are only intended for use by residents of the United States. By using the Services, website, Portal and App, you confirm that you are a resident of the United States.

Services are Not Medical Advice

The content that we may provide through the HealthfulHeroes.com website, Web Portal and future Mobile App is not intended to replace consultation with a licensed healthcare professional for the diagnosis, cure, mitigation, treatment or prevention of disease, injury or other conditions. You should not rely upon any content we provide through these services in any of your own healthcare or medical decision-making.

Contributor Eligibility

To become a Contributor and access the area on this Site reserved for Contributors (the “Contributor Area”), HSI requires that you are either a (a) diagnosed patient of the particular illness for which you are providing Content or a parent or legal guardian acting for such a patient who is under 18 years of age or incapacitated, (b) caregiver for a patient eligible to contribute such content, (c) health care professional (e.g. doctor, nurse, health researcher, etc.), (d) guest with legitimate, non-commercial reasons to contribute or (e) guest as authorized by a HSI employee. Children under the age of 13 are prohibited from registering as Contributors. By becoming a Contributor you represent that you are age 13 or older.

Information Collected from You

When you access HealthfulHeroes.com, several types of data may be collected from you, including: (1) Non-Personal Information; and (2) Personally Identifiable Information. Certain types of data are specifically NOT collected, including financial account information and personal information from children.

• Non-Personal Information. We may automatically collect certain data regarding use of or access to the HealthfulHeroes.com and related ‘Tools’, such as:
• The type of device you use to access the Tools;
• The date and time you access the Tools;
• The type of web browser you use to access the Site; and
• The sections within the Tools that you access.
• We may also collect the IP address, user language, the operating system, the presence/absence of “flash” plug-ins, screen resolution, and connection type that you use to access the Tools.
• This information (collectively, “Non-Personal Information”) does not, by itself, personally identify users. We use this Non-Personal Information to monitor the effectiveness of the Tools, to help personalize your online experience and to consider potential improvements to the Tools. Non-Personal Information may be collected through cookies. For more detailed information on cookies, please refer to the “Use of Cookies” section below.
• Personally Identifiable Information. You are able to view and download content displayed on the portion of the Site that is accessible to the general public without disclosing any information that, either alone or in combination with other information, can be used to uniquely identify, contact or locate you (collectively, “Personally Identifiable Information,” or “PII”). However, certain restricted portions of the Site, and access to the App in its entirety, require disclosure of certain PII, as further described below. By providing such information, you consent to our collection and use of it, as described in this Privacy Policy.
  • User Authentication and Contributor Screening. In order to access certain restricted portions of the Site, and to access the App, you must have and login with a HealthfulHeroes.com Healthful Contributor account. Creation of a Healthful Contributor account (if you do not already have one) requires you to provide your name and email address as well as additional information. Please note, creation and maintenance of your Healthful Contributor account is handled by Healthful Stories, Inc and is governed by this privacy policy. We may receive certain information from other sign-on or login management tools, not limited to Google, Facebook, etc. and may receive information from these entities, such as email address.
  • Once you have logged in with your Healthful Contributor account, we will ask certain screening questions to determine your suitability to Contribute your Healthful Story. You will be asked to create a Healthful Contributor profile as well as share your Healthful Story described below. You will also have the option to sign-up for our mailing list to stay informed of future opportunities to participate in research studies, which requires you to provide your email address.
  • Before creating your Healthful Contributor Profile, you must review both our Terms and Conditions of Use as well as this Privacy Policy that describes the type of information that we will collect when you contribute your Healthful Story, and how we will use that information. The online consent describes how, upon Contribution of your Story through our Healthful Survey, your information will be used, what information may be requested of you in the future, and how certain of this information could be shared with others outside of Healthful Stories, Inc.
  • Throughout the course of your status as a Contributor to HealthfulHeroes.com, you may also be requested to provide periodic health updates and to respond to certain surveys on relevant topics.
• No Personal Information from Children. We do not knowingly collect personal information from children under the age of 13. Children are not permitted to use the Tools, and we request that children under the age of 13 not submit any personal information to through the Tools. Since information regarding children under the age of 13 is not collected, we do not knowingly distribute personal information regarding children under the age of 13. For additional information, please refer to the “Children and Parents” section below.
• Other Information NOT Collected. Our services and your use of the Tools does not require you to disclose, nor require us to request or collect, any credit card or other financial account information. We do not request, solicit or intend to collect any such information and you should not disclose, enter or upload any such information through the Tools. If we discover that such information was disclosed by you, we may delete such information; however, we are not liable for any consequences relating to such disclosures of information.

Use and Disclosure of the Information Collected

The use and disclosure of certain information varies with respect to the type of information collected, including: (1) Non-Personal Information; and (2) Personally Identifiable Information.

• Use of Non-Personal Information. We use the Non-Personal Information collected through the Tools for statistical and research purposes and for improving the functionality of the Tools. This information may also be used for administrative purposes including, without limitation, to troubleshoot and resolve problems with the Tools. We may rely on third-party partners to collect and analyze the Non-Personal Information.
• Use of Personally Identifiable Information. As described above, the PII collected may be used for a variety of purposes, including responding to your requests for information, commercial product research and development, Contributor eligibility screening, creation of your Healthful Contributor Profile and engagement with other Healthful Contributors. Your PII may be used to create a de-identified data set. We may share your PII with business partners or service providers we use to, without limitation, provide aggregated, de-identified insights to power systemic healthcare transformation per our Healthful Mission.
• Additional Disclosures. Though we make every effort to preserve your privacy, disclosure of PII to third parties may occur in certain situations such as: (i) responding to a subpoena, court order or other such request; and (ii) responding to a law enforcement agency’s request or as otherwise required by law. In all such instances, we will take the utmost care to disclose only that information which is necessary and appropriate under the circumstances.

Use of Cookies

Cookies are small bits of data cached or stored on your computer or smartphone based on Internet activity. We may use cookies to monitor individual activity in aggregate to improve the Tools and provide features that are tailored to your needs. Most web browsers automatically accept cookies, but you can usually change your browser settings to prevent this. If you disable cookies, your ability to use some features of the Tools may be limited. We also use session cookies when you visit the Site or otherwise use the Tools. Session cookies are active only during the period you are logged into the Tools, and are removed when you leave.

In addition to the third-party entities referenced above, we may provide links to other third-party websites through the Tools solely as a convenience to you. However, such linking does not mean, and should not be interpreted to mean, that Healthful Stories, Inc. endorses, is affiliated with or makes any representations concerning such third-party websites. HSI neither reviews, nor controls, nor is responsible for these third-party sites or any content therein. By using such links, you will leave the Tools. If you decide to access any of the third-party sites linked to the Tools, you do so entirely at your own risk. HSI shall not be liable for any consequences arising from use of any third-party websites to which the Tools link.

Security

We strive to maintain the security of your information by using appropriate measures designed to protect our systems. However, we cannot guarantee the security of any information that is disclosed online. Consequently, we do not insure or warrant the security of any information you transmit, and you do so at your own risk. Use of the Internet is solely at your own risk and is subject to all applicable local, state, federal, and international laws and regulations. While we have endeavored to create a secure and reliable site, please be advised that the confidentiality of any communication or material transmitted to us over the Internet cannot be guaranteed. Consequently, neither we nor our Affiliates are responsible for the security of any information transmitted via the Internet, the accuracy of the information contained on this Site, or for the consequences of any reliance on such information. You must make your own determination as to these matters.

Children and Parents

Use of the Tools is not offered to children. If you are under 13, you may not use the Tools. We do not intend to collect personal information from children. If your child has submitted personal information, please contact us to request that such information be removed. Once we are aware of information entered by a child, we will exercise commercially reasonable efforts to remove such information from our databases and storage areas; however, we are not liable for any consequences relating to such information. Your Login Information

You are responsible for maintaining the confidentiality of your member password and login, and are fully responsible for all activities that occur under your password or account with or without your knowledge. If you knowingly provide your login and password information to another person, your membership privileges may be suspended temporarily or terminated. You agree to immediately notify HSI of any unauthorized use of your Contributor password or login or any other breach of security.

Contributor Termination

You agree that HSI may, with or without cause, immediately terminate your HSI Contributor status or limit or terminate your access to the Contributor Areas or the Site without prior notice. Without limiting the foregoing, the following may lead to a termination by HSI of a Contributor’s status and use of the Site: (a) breaches or violations of this Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated Contributorship cancellation), (d) unexpected technical issues or problems, and (e) extended periods of inactivity. HSI has no obligation to maintain, store, or transfer to you information or data that you have posted on or uploaded to the Site.

Modifications of this Agreement

We reserve the right to modify this Agreement at any time, and without prior notice, by posting amended terms on this Site. We encourage you to review this Agreement periodically for any updates or changes, which will have an update effective date.

Disclaimer of Warranties

The Site and the content and services made available on the Site are provided on an “as is” and “as available” basis. HSI does not make and disclaims all express and implied warranties and representations, including, but not limited to, any implied warranty of fitness for a particular purpose, with regard to the Site, the Site content, or any advice or services provided through the Site to the extent permitted by law. HSI does not warrant that access to the Site or its content or services will be uninterrupted or error-free or that defects in the Site will be corrected. The advice, recommendations, information, and conclusions posted or emailed by other members of the Site are not in any way vetted, approved or endorsed by HSI, and you use such information at your own risk.

Limitations of Liability

Under no circumstances shall HSI, its partners, contributors, agents, employees, directors, or affiliates be liable for any indirect, incidental, special, or consequential damages (even if it has been advised of the possibility of such damages) due to your use of this Site or due to your reliance on any of the content contained or the services provided on the Site.

Indemnification

You agree to indemnify and hold harmless HSI, its officers, employees, agents, subsidiaries, affiliates and other partners, from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of this Agreement.

International Contributors

HSI makes no claims that information on the Site is appropriate or may be downloaded outside of the United States. Personal information (“Information”) that is submitted to this Site will be collected, processed, stored, disclosed and disposed of in accordance with applicable U.S. law and our Privacy Policy. If you are a non-U.S. User/Contributor, you acknowledge and agree that HSI may collect and use your Information and disclose it to other entities outside your resident jurisdiction. In addition, such Information may be stored on servers located outside your resident jurisdiction. U.S. law may not provide the degree of protection for Information that is available in other countries. By providing us with your Information, you acknowledge that you consent to the transfer of such Information outside your resident jurisdiction as detailed in our Privacy Policy. If you do not consent to such transfer, you may not use this Site.

Contributor Notices

If you register as a Contributor, you agree that HSI may send notices to you by email at the email address and/or social media information and/or other contact information you provide when registering to become a Contributor (or which you later update using the functionality of the Site).

Governing Law and Venue

This agreement shall be governed by the laws of the State of Delaware and the applicable federal laws of the United States of America.
